All laser products intended for sale in the US have to be certified, even the CD ROM drive for a computer and a Sony Walkman have CDRH paperwork on file.
Even though one does not need a variance to buy and publicly use a 4.95 Mobolazer, Chauvet, etc, those companies themselves are laser product manufacturers and must have a variance on file and do a product report for all their laser products.
Also, the same exposure rules apply to the users of these 4.95 mW systems as well as the Class IV laser show system.
Many a person has gotten in trouble here in Arizona for aiming their 4.95 mW lasers into the audience for example, not realizing that they still have to follow certain rules just as the varianced laser operators must.
I bet Sony does not have to wait over a year for a new laser product's paperwork to be approved by the CDRH... Funny, I built a projector almost two years ago that I still cannot legally use....
