    I also heard nothing, can we assume he's had an accident? I hope not or as you say we have been scammed. Again I hope not, I glad I kept his address details should I need to report this to the authorities.

    In view of his continued silence, I think it is appropriate to do something rather than just complain. If his address is known then anyone who has an outstanding order with him, especially if they live within the same state should send him a notarized and certified letter expressing their concern about his failure to send the items (list them along with the amount of money sent and when). Demand a response within a reasonable time; for example 10 business days.

    He can be sued in small claims court for up to $5,000 (I believe this is the limit in Michigan). This is pretty easy to do, does not require a lawyer, is done largely at your convenience and the posts from the forum as well as the others who are in a similar situation puts him at a heavy disadvantage. By making clear your position and doing so in writing may be enough to cause him to respond if he doesn't want to go down that route.

    Thanks Planters, that's good advise.

    I'm in the UK, I will hope that we soon get a response from Kiyoukan very soon to resolve the outstanding issues, If anyone involved in this GB requires his details then I'm happy to share the details as shown on the received package from Kiyoukan.

    I'm not giving any info that any other member would not already received.

    If there is no resolve to this then it leaves no alternative than to follow your advice.

    I hope we don't need to go that far thou.

    anything over $500 is a felony and should be filed as such I for one am all for following action. its not just the scamming of the money but hurting the trust on PL for group buys.

    I think that advise might be a little premature (not wrong mind you, but just not necessarily yet). The rub is that in this arrangement I do not think he made any commitment to deliver within a specific time frame. But, the reasonable expectation under this contract ( and this is a contract) was that he would deliver the items as soon as he was able. The judge is going to ask what did he offer to do, was it doable, did he do it and if not why. I very much expect that if there are no justifications for his failure to preform his part,it will be ordered that he return the money.

    Chris, I did look into the resolution centre but it will only accept a dispute upto 45 days, unless you know of a different route?

    Obviously I love to get the money back.

    I'm much more concerned about hearing from him just to make sure he's alright. God forbid the guy got hit by a bus or something.

    I did receive a bunch of the original GB lenses several months ago. The suspicion arises from the delays then the strange posting in June and then nothing. A bus accident doesn't do that.
