1- Did you have te polarity right? (cold side up warm side down)
2- Is the die4cill board working properly?
3- Do you have the diode running when it gets hot or are you testing without he diode running? (maybe the tec hasn't enough capacity to fight the heat of the diode)
yeah cold side is up and it works.
no the diode is not running im just testing

it almost sounds like the alluminium base plate isn't despersing heat from the tec fast enough...
Is there a good termal connection between them?
Did you use paste or thermalgrease/glue?
(try testing the tec setup without the die4chill board, if it still getting hot... there is a termal connection problem)
Does it get cold then hot? If so, I would probably guess that you aren't pulling the heat away fast enough. That heatsink arrangement you have seems questionable to me.
Are you running the TEC straight off of a DC source? Are you sure you're limiting the current to the TEC? If you run a TEC with no current limiting, they will get very hot on both sides!
